EC restaurant owner charged with sexually assaulting coworker

Eau Claire (WQOW) – An Eau Claire restaurant owner was arrested for allegedly sexually assaulting one of his coworkers at their place of employment.

Filiberto Rivera, 53, is charged with third degree sexual assault. He is the owner of Manny’s Cocina in Eau Claire.

The victim told police Rivera had been offering her drinks for the past few weeks. She said she finally decided to stay after work to “get it over with.”

According to the criminal complaint, after the victim had her drink, Rivera started asking her a lot of sexually-related questions. She said she started feeling “really drunk really fast.”

The victim said that’s when Rivera came out from behind the bar, put his hand on her back and started to push her onto the bar. She said he poured alcohol into her belly button and drank it out three or four times. She said she was “frozen in the moment and let it happen.”

The victim told police Rivera pulled down her pants and underwear and touched her inappropriately. She said she told him stop, but instead he lifted up her shirt and touched her more.

According to the complaint, Rivera kept asking the victim to have sex, to which she kept saying no. The victim said she did not consent to being touched under her shirt or pants.

If convicted on all the charges,  Rivera faces up to 10 years in prison.
