Plea deals reached following gun incident at North HS parking lot

Eau Claire (WQOW) –The suspects charged in a gun incident at Eau Claire North High School ealier this year have reached plea deals with prosecutors.

According to the criminal complaint, Benjamin Weinberger and Tracy Gawlitta came out of their home and confronted a group of teens playing loud music in the parking lot.

Witnesses said Weinberger became upset and pulled a handgun from his waistband. Weinberger admitted the incident to police and said he had been drinking heavily.

On Wednesday, Weinberger pleaded no contest to operating a firearm while intoxicated. Judge Sarah Harless sentenced him to 80 days of community service and court costs.

Gawlitta pleaded no contest to disorderly conduct. She was ordered to pay court costs.

According to the criminal complaint, Benjamin Weinberger and Tracy Gawlitta came out of their home and confronted a group of teens playing loud music in the parking lot late Friday night.

Witnesses said Weinberger became upset and pulled a handgun from his waistband.

Weinberger admitted the incident to police and said he had been drinking heavily.

A breathlalyzer test registered a 0.201.

Weirberger is charged with operating a firearm while intoxicated.

He and Gawlitta are also charged with disorderly conduct.

They return to court in October.
