Eau Claire (WQOW) – A lawsuit filed against the City of Eau Claire was thrown out by a judge in Eau Claire County Court on Wednesday.

A lawsuit filed by Voters with Facts claimed the City of Eau Claire illegally used TIF (tax incremental financing) dollars to build the Aspenson Mogensen building on Water Street.

According to the City of Eau Claire, that lawsuit was thrown out on Wednesday because the suit was not filed in time.

The City says these type of lawsuits need to be filed within six months of the TIF being created. They say this lawsuit was filed more than 18 months after the creation of the Water Street TIF.
