Charges filed against man shot by Eau Claire County deputies

Charges have been filed against the man who was shot after allegedly confronting Eau Claire County deputies with a gun last week.

Reese Diesterhaft, 23, is now charged with armed burglary, possessing a firearm as a felon, criminal damage and fleeing officers. 

One week ago a harassment complaint in Dunn County led to a chase that ended in the township of Brunswick. Eau Claire County Sheriff Ron Cramer told News 18 Diesterhaft confronted officers with a weapon, and two Eau Claire County deputies fired at him.

According to the criminal complaint, Diesterhaft told investigators he was on the run from authorities in South Dakota and returned to Wisconsin to see his family before he killed himself.

He said his plan was to use one of his father’s weapons, but because his dad only had long rifles and not a handgun, he wanted to, "do something stupid," and get police called so they would shoot him. He told officers he did not want to go back to prison.

Diesterhaft described to investigators how he stole a rifle from a home between Rock Falls and Caryville. He then tried to kiss a woman he did not know at a grocery store in Rock Falls so that she would call police.

Once law enforcement made contact, he led them on a chase intentionally using back roads saying he didn’t want anyone else to get hurt.. After he lost police, he said he "got bored" and purposefully drove back to find officers so that they would shoot him.

After he was first shot in the stomach, Diesterhaft told investigators he stood up so that deputies would be forced to shoot him again.

James Haworth and Daniel Eaton were identified as the two deputies who shot Diesterhaft. Per state policy, they have been placed on leave pending the outcome of the investigation.

Diesterhaft returns to court on these charges Friday.

Reese Diesterhaft, 23, appeared on the monitor during his hearing in Dunn County, with his hand on his abdomen. The court date was for charges of theft and contributing to the delinquency of a minor from 2012. He is also being held on charges from South Dakota and in Eau Claire County.

His attorney requested a signature bond, because he was on hold for his parole in South Dakota, but, the request was denied.

"I am going to order a $10,000 cash bail," said Judge James Peterson of Dunn County. "He is a serious flight risk."

Diesterhaft will face charges from Tuesday’s incident, but they haven’t been filed yet. An initial appearance on the previous charges is set for Tuesday, August 14.
